Conditions of Mobile Food Trucks

1. Mobile Food Vehicles are allowed as a permitted use in the following zoning districts: C-1, C-2, C-OR, C-TR, C-RO, Industrial. In addition, Mobile Food Vehicles may operate on other zoned public or private property locations, or in the public right of way, but only as part of a permitted Special Event. 

2. Mobile Food Vehicles shall comply with all zoning requirements of the district in which the use is to be established. 

3. Mobile Food Vehicles shall comply with section 10 – Development Standards of the Clear Creek County Zoning Regulations, as well as any other applicable requirements. 

4. Mobile food vehicles must meet setbacks for the zoning district in which the use will reside, unless a variance has been granted for setback encroachment. 

5. Sanitation facilities are required for all mobile food vehicle operations in accordance with the County Environmental Health Department Regulations. 

6. Operators must dispose of all waste in accordance with the County Environmental Health Department Regulations. 

7. Provide proof of, and maintain, a valid driver’s license, vehicle registration and current motor vehicle insurance. 

8. Provide proof of, and maintain, a Colorado Retail Food License for a mobile unit. 

9. Provide proof of, and maintain, a valid sales use tax license 

10. No person who operates any Mobile Food Vehicle on public property or private property shall obstruct parking lot circulation or block access to a public street, alley or sidewalk. 

11. An appropriate sized trash container is required for all Mobile Food Vehicles. An animal proof trash container is required if the mobile food vehicle will remain on site over night or will be left unattended for any amount of time. 

12. The subject property must have a driveway that is permitted for commercial use. 

13. Mobile Food Vehicle operations shall provide adequate parking as described below: 

a. Operations that utilize tables, chairs, or other types of eating areas shall provide the required amount of parking spaces as delineated in section 1005.1.5.2 (7) (c) of the Clear Creek County Zoning regulations. All other operations shall provide adequate parking so that vehicle circulation patterns are not disturbed on the site and parking does not occur on the street. 

b. If a mobile food vehicle is proposed to operate within an existing parking lot for an existing business, then parking shall be recalculated for both the existing business and the mobile food vehicle, based on section 1005 of the Clear Creek County Zoning Regulations, to ensure that adequate parking is maintained for the property. 

14. This permit is non-transferable 

15. This Special Use Permit expires in one year
